Action commenced March 12, 1949 by Green Bay-Wausau Lines, Inc., a Wisconsin corporation, against Irene Mangel, Otto Albert Mangel and the American Casualty Company, a foreign corporation, for damages. From a judgment dated August 1, 1949, in favor of plaintiff, defendants appeal. The appellant alleges that the plaintiff's driver was proceeding in an easterly direction on Highway 29, about 4 miles south of Shawano and approaching a point where a driveway to a wayside park intersects the north side of the highway. The defendant's car was moving in an easterly direction ahead of the bus of the plaintiff, and the driver of the car 'did * * *, without warning or signal of any kind, suddenly and abruptly swing, drive and operate the automobile then and there by him driven and operated, toward his left and towards the entrance of said driveway to said wayside park.' It is further alleged that upon being confronted with the emergency and to avoid a collision with the vehicle of the defendants, the driver of the plaintiff's bus turned to the left and in doing so collided with a culvert and stone pillar at the entrance of said wayside park. This resulted in damage to the equipment of the plaintiff.
